1. Acceptance of Terms

Welcome to Käkedom Tools. By accessing or using our website, platform, services, IoT devices, or attending our workshops, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Käkedom Tools, an agricultural technology and education platform serving refugee farmers in Kiryandongo Refugee Camp, Uganda.

2. Our Mission and Services

Käkedom Tools is dedicated to empowering refugee farmers through:

• Hands-on farming workshops and education programs
• Access to essential farming tools, seeds, and resources
• IoT-based soil monitoring and environmental sensor technology
• Yield prediction and water management guidance
• Resource sharing and community learning platform
• Seed bank and sustainable agriculture practices

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 16 years old to use our services. If you are under 18, you should have the consent of a parent or guardian to participate in our programs.

3.2 Account Registration

To access certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Use of Services

4.1 Permitted Use

You may use our services for lawful purposes related to agricultural learning, farming improvements, and community development. Specifically, you may:

• Access educational content and farming resources
• Participate in workshops and training programs
• Use our IoT devices to monitor your farm's soil and environmental conditions
• Share knowledge and experiences with other farmers in the community
• Request seeds, tools, and farming supplies through our resource sharing program

4.2 Prohibited Activities

You agree NOT to:

• Use our services for any illegal or unauthorized purpose
• Violate any local, national, or international laws
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or any harmful code
• Interfere with or disrupt the operation of our services or servers
• Attempt to gain unauthorized access to our systems, accounts, or networks
• Harvest or collect information about other users without consent
• Use our IoT devices for purposes other than agricultural monitoring
• Resell, redistribute, or commercially exploit our services without permission
• Post or share offensive, harmful, or inappropriate content

5. IoT Devices and Equipment

5.1 Device Usage

If you are provided with or use our soil monitoring IoT devices:

• The devices remain the property of Käkedom Tools
• You agree to use them responsibly and only for their intended agricultural purposes
• You must report any damage, malfunction, or loss immediately
• You may be responsible for damage caused by misuse or negligence
• We reserve the right to retrieve devices at any time

5.2 Data Collection

Our IoT devices collect soil moisture, temperature, pH levels, and other environmental data. By using these devices, you consent to the collection and use of this data as described in our Privacy Policy.

6. Workshop Participation

When participating in our workshops and training programs:

• You agree to treat facilitators, staff, and fellow participants with respect
• You must follow safety guidelines and instructions provided
• You acknowledge that farming activities involve inherent risks
• You participate at your own risk and release Käkedom Tools from liability for minor injuries
• You may be photographed or recorded for educational and promotional purposes (unless you opt-out)

7. Intellectual Property Rights

7.1 Our Content

All content on our platform, including text, graphics, logos, images, videos, software, and educational materials, is the property of Käkedom Tools or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our platform and content for personal, non-commercial agricultural purposes. You may not:

• Copy, modify, or distribute our content without permission
• Reverse engineer or decompile our software or devices
• Remove copyright or proprietary notices

7.3 User Content

By sharing content on our platform (photos, farming experiences, tips), you grant Käkedom Tools a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content for educational and promotional purposes. You retain ownership of your content.

8. Disclaimers and Limitations of Liability

8.1 No Warranty

Our services, platform, and IoT devices are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

• Our services will be uninterrupted, secure, or error-free
• The information provided is always accurate or complete
• Specific farming results or yields will be achieved
• IoT devices will function perfectly at all times

8.2 Farming Advice Disclaimer

While we strive to provide helpful and accurate agricultural information, farming outcomes depend on many factors beyond our control (weather, soil conditions, pests, etc.). We do not guarantee specific results. You are responsible for your own farming decisions and practices.

8.3 Limitation of Liability

To the fullest extent permitted by law, Käkedom Tools shall not be liable for:

• Crop failures or reduced yields
• Loss of profits or income
• Indirect, incidental, or consequential damages
• Damage to property or equipment
• Errors in data from IoT devices

Our total liability for any claim related to our services shall not exceed the amount you paid to us (if any) in the past 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless Käkedom Tools, its staff, volunteers, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post or share on our platform

10. Termination

10.1 By You

You may stop using our services and delete your account at any time by contacting us at info@kakedomtools.org.

10.2 By Us

We reserve the right to suspend or terminate your access to our services, with or without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your conduct harms other users or Käkedom Tools
• We are required to do so by law

10.3 Effect of Termination

Upon termination, your right to use our services will immediately cease. You must return any IoT devices or equipment provided to you. Provisions of these Terms that by their nature should survive termination will continue to apply.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

14.1 Informal Resolution

If you have a dispute with Käkedom Tools, please contact us first at info@kakedomtools.org or call +256 774 330 491. We are committed to resolving issues amicably and fairly.

14.2 Governing Law

These Terms are governed by the laws of Uganda. Any disputes that cannot be resolved informally shall be subject to the jurisdiction of the courts in Uganda.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending you an email notification (if you have an account)
